If your facility manufactures packing foam or other types of chemically reactive plastics and styrenes, then EPCRA Section 313 "chemical processing" reporting requirements may apply to your facility. See below for more details.

Form R Applicability to Packing Foam

If a SARA 313 toxic chemical is used in a chemical reaction to form packing foam, the toxic chemical is considered "processed" and should therefore be counted toward the 25,000 pound threshold for that toxic chemical. If the toxic chemical is a PBT (persistent bioaccumulative toxic), it has a lower threshold of 0.1 grams, 10 pounds, or 100 pounds, depending on the chemical.

EPA's definition of "process" in 40 CFR 372.3 includes the incorporation of a toxic chemical into a product that is then distributed in commerce. If the facility processes the chemical at or above the applicable threshold, a Form R or Form A for the chemical must be submitted to EPA by July 1st each year.
