This is a question about medical
leave of absence and how it may
or may not affect LWDII rates.
Say an employee is injured 2/15 and is
off work until placed and released with
permanent restrictions on 5/7. We are
unable to accommodate the restrictions
so we cannot return the employee to
active work. Our policy is to allow
our "can't accommodate" folks to stay
administratively attached to the company
through unpaid medical leave up to 12
months from the first day off work -
in this case 2/15. OSHA says to stop
counting days off work for the 200 Log
on 5/7, but to put an asterisk beside
the person's name and note the
situation on the bottom of the line.
Our employment OSHA advisor says to not
use the asterisk because it will draw
OSHA attention to our form.
We would like a third opinion on how to
track days off work correctly, an
explanation of how the LWDII rate is
figured by OSHA, and if our extended
medical leave policy affects this
rate in any way.
